Former Yes Member Sues To Stop Release

(07/18/02) -- Tony Kaye, the original Yes keyboardist and founding member, is suing the band because of an upcoming DVD and boxed set release.

Kaye left the band in 1972 due to internal band issues and improper payment of royalties. He says he was not consulted about the release of the boxed set. Kaye claims 25% ownership of the band name as well as publising entitlements for certain songs.

Kaye is suing Warner publishing companies with intentional and negligent misrepresentation, tortious interference with written contract and breach of good faith and fair dealing. He is asking for a temporary restraining order and injunctions against Warner to prevent the release of the boxed set, along with punitive damages and reimbursement of court fees.

The suit was filed Tuesday in a Los Angeles Superior Court.

Also, how can Tony claim 25 percent ownership of the band name? The only time that Tony was one of four members in the band (each one could "claim" 25 percent ownership, I suppose) was when Jon left in the late '80s. Currently, only five people can claim ownership of the name, as members, and that would be the five current members. And do the members really own the band name, or does somebody (or something, a corporation) else own it?
