Hi,

If I tried to Get better tickets this Saturday and I anage to get some better ones to replace my junk ones, would selling my old tickets be scalping..

I will be using EBAY because I don't want to mess around trying to dump my tickets.. I don't care if I lose money or make money off the deal..

Scalping is only if you sell the tickets for over the face value. Also, laws agaisnt scalping vary from state to state. In some states it is legal to scalp. But regardless, if you sell the tickets for face value, then you will be fine.

Yes the best bet would be to sell them for face value.
Especially considering how expensive you thought they were in the first place....we wouldn't want anyone else to experience the similar humiliation of the feeling of Jon Anderson "slapping them in the face."

You should check out the hubs via Yesworld to buy/sell/trade your tickets. It seems all posters there are selling/trading for face value only. That is the fair/right thing to do.
Also most venues release/release good/better tickets as the event date nears. Check Ticketscrewer/venue boxoffice often.

Face value does include the shipping costs I also had to pay right?

YES...check out the hubs @ Yesworld; all posts regarding ticket sales include shipping and other service/"convenience" charges.

I wouldn't worry about any legal recourses for including the shipping that you had to pay in the ammount you are charging. When it comes to scalping, there has to be the intent to make a profit. You are just recouping your costs. But regardless, no law enforcement agency has the time to investigate someone selling tickets to a Yes show for over face value. (Now if you did it on a regular basis in a State that is illegal, then I would be concerned).

You may want to check if Ebay has a policy on selling tickets to shows.

Are they better seats than what is being offered by ticketmaster? If not, then you may have a hard time selling them for face value+shipping.
